Terms of Service — Sunny Side Up

Draft. Prepared for a capstone/master’s project. Before this is shown to anyone real, check it against Ukrainian consumer-protection law and against a lawyer if one is available. These terms describe the product honestly as built; the legal framing is not reviewed.

1. What this is

Sunny Side Up is a student engineering capstone project — you photograph or describe a dish, the app recognises it and estimates the portion, and nutrition figures come from a verified food database where one exists. It is built and run by one person to demonstrate the idea and gather feedback, not a company and not a production service with an operations team behind it.

This is a test application. Please do not enter real personal or health information. See the same warning, and why, in the privacy policy.

By using it you agree to these terms and to the privacy policy, which describes what is held, why, and how to view, correct, export or delete it.

2. Access

The product is invite-only while in beta. An invitation does not create an ongoing entitlement — access can be limited, suspended or withdrawn at any time, for any reason, including simply because this is a student project that may not run indefinitely.

You must be 18 or older to use it, matching the age limit in the privacy policy.

3. Not medical advice

Nutrition figures, portion estimates and the AI feedback after a meal are for personal, informational tracking only. They are not medical, dietary or clinical advice, are not a diagnosis, and are not a substitute for a doctor, dietitian or other qualified professional — especially for an allergy, a medical condition, or anything a wrong number could make worse. An unmarked number is grounded in a verified database; a marked one is the model’s own estimate and may be wrong. Use judgment, and confirm or correct every estimate before relying on it, which the app already requires before saving it.

4. Acceptable use

Use the product for its intended purpose — describing and logging your own meals. Do not:

• attempt to bypass sign-in, rate limits or the invite-only restriction;
• attempt to access another person’s account or data;
• upload a photograph or description containing anything illegal, or content you do not have the right to share;
• attempt to disrupt, overload or reverse-engineer the service beyond normal use.

5. Your content

What you upload — descriptions, photographs, corrections — stays yours. Using the product does not transfer ownership of it to anyone. It is processed only to provide the service, as the privacy policy describes, and is never shown to any other user: there is no public or shared view anywhere in the product.

6. Termination

You can stop using the product and delete your account at any time through the in-app controls, which removes everything it holds about you, per the privacy policy.

Because this is a student project and not a funded, staffed service, it may be suspended, changed or shut down entirely with little or no notice — including at the end of the capstone term it was built for. If that happens, the export control described in the privacy policy is the way to keep a copy of your own data beforehand.

7. No warranty, and its limits

The product is provided as is, with no warranty of any kind — no guarantee it is accurate, available, uninterrupted or fit for any particular purpose. It is an engineering demonstration, not a hardened production service; a review of what that means at this stage is in the root CLAUDE.md of the project’s own repository, publicly available to anyone who asks.

To the extent the law allows it, use of the product is at your own risk, and nobody behind it is liable for a loss arising from using it or from being unable to use it. Nothing here limits a right the law does not allow limiting.

8. Changes to these terms

These terms may change. Material changes are announced in the app, the same way a change to the privacy policy is.

9. Contact

Same as the privacy policy: there is no dedicated contact channel for this project. The in-app controls are the way to exercise anything these terms or the privacy policy describe.
